JUDGMENT / ORDER

Rule.
Learned APP Mrs. Hansa Punai waives service of Rule on behalf of the respondent No.1 - State and Mr. Y.N. Ravani waives service of Rule on behalf of the respondent No.2.
This application has been preferred by the applicant with a prayer to delete the condition No.IV imposed by this Court in order dated 5.8.2010 passed in Criminal Misc. Application No.8865 of 2010.
Heard.
Perused the application along with paper. This Court while enlarging the petitioner on bail passing order dated 5.8.2010 in Criminal Misc. Application No.8865 of 2010, the condition No.IV is imposed with regard to his marking presence before the CBI, ACB, Gandhinagar. The petitioner is residing at Baroda and therefore, he is facing hardship to mark his presence before concerned officer. The charges are levelled against the applicant for the offence punishable under Section 7 of the Prevention of Corruption Act and 120(B) of the Indian Penal Code. The applicant being public servant, therefore, all his rights are intact with the Government and he is regularly marking his presence before the CBI, ACB, Gandhiangar. Therefore, considering the facts and circumstances, the condition No.IV imposed by this Court vide order dated 5.8.2010 in Criminal Misc. Application No. 8865 of 2010. Rule is made absolute.
