JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through temporary bail for a period of 40 days for his own treatment.
In the application, it is mentioned that in the year 2007, he had met with an accident as he had fallen down from vehicle and sustained serious injuries in the head and he was operated for the same and after operation, he is having certain complaints.
Learned APP invited attention of the Court to the communication dated 4.6.2012; wherein, he stated that:
"1. The patient is a case of post traumatic head injury with complaints of headache and seizures.
2. He had one episode of seizures every alternate month.
3. The medication is requires for very long period.
4. Psychiatric counselling is needed as advised by expert of S.S.G. Hospital Vadodara.
5. His treatment is observed by doctors of jail dispensary and S.S.G. Hospital, Vadodara".
Taking into consideration the contents of the aforesaid communication, this Court is of the opinion that there is no justification for releasing him on temporary bail for a short time. From the jail remarks, it can be seen that he has enjoyed furlough leave in the month of March-April, 2012.
Hence, the application is rejected.
