The applicant is not the party in the main proceedings, i.e. First Appeal No. 1768 of 2008. Therefore, this application cannot be entertained.
The learned advocate for the applicant is at liberty to move appropriate proceedings for bringing legal heirs on record of the First Appeal. The application stands disposed of accordingly.
First Appeal is fixed for hearing on 28.02.2012.
