By this application, the applicant seeks issuance of fresh notice in the civil application and second appeal upon the respondent No.1.1 at the address shown in the memorandum of application, and seeks permission to delete the respondent No.2 from the array of respondents in both the civil application as well as second appeal.
Heard Mrs. Vaibhavi Nanavati, learned advocate for the applicant.
Having regard to the averments made in the application, the application is allowed. The applicant is permitted to amend the cause title of Civil Application No.11641 of 2011 as well as Second Appeal No.221 of 2011, by substituting the address of the respondent No.1.1 as shown in paragraph 2 of the memorandum of application. The applicant is also permitted to delete the respondent No.2 from the array of respondents in Civil Application No.11641 of 2011 as well as Second Appeal No.221 of 2011.
In the aforesaid circumstances, Issue Fresh Notice to the respondent No.1.1 in Civil Application No.11641 of 2011 as well as Second Appeal No.221 of 2011, returnable on 30th April, 2012.
The application stands disposed of accordingly.
