Heard learned counsel for petitioner as well as learned Additional Government Advocate for the State.
This writ petition has been filed challenging FIR dated 21.04.2021 registered at FIR/Case Crime No.0046 of 2021, under Sections147, 148, 149, 307, 452, 506 IPC, 1860 and Sections 27 & 30 of Arms Act, 1959, Police Station Karaudi Kalan, District Sultanpur.
After arguing the matter at some length, learned counsel for the petitioner states that he may be permitted to withdraw this writ petition with liberty to the petitioner to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioner approaches the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
