Heard learned counsel for the petitioner as well as learned AGA appearing for the State respondents and perused the record.
Present petition has been filed for quashing the first information report dated 19.10.2021 registered as Case Crime No. 459 of 2021, under Section 306 IPC, Police Station Khekra, District Baghpat.
At the very outset, learned counsel for the petitioner prays that he may be permitted to withdraw present petition.
From perusal of list of fresh cases, we find that a Criminal Misc. Writ Petition No. 10370 of 2021 ( Bittoo @ Yogendra And 3 Others vs. State of UP and 2 others) has already been dismissed on 7.12.2021 leaving it open for the petitioner to apply before the competent court for anticipatory bail/bail as permissible under law and in accordance with law.
In such view of the matter, we do find find any good ground to take a different view in this matter.
Present petition is accordingly dismissed.
