By means of present writ petition, the petitioners are seeking a writ in the nature of certiorari for quashing of the transfer order dated 22.05.2010, as contained in Annexure No.1 to the writ petition. Petitioners have further prayed for a writ of mandamus commanding the opposite parties to enforce the implementation of the transfer policy dated 21.04.2010 (Annexure-2) and for further direction to opposite parties not to give effect the transfer order.
After arguing at some length, learned counsel for the petitioners restricts his prayer to the extent that interest of justice would be served if necessary directions be issued to the opposite party no.2 to consider and decide the representation of the petitioner dated 24.05.2010 (Annexure-3) by a speaking and reasoned order within a stipulated period of time, fixed by this Court.
Learned Standing Counsel has no objection to the prayer of learned counsel for the petitioners for being considered the representation of the petitioner by the competent authority.
In view of the above, with the consent of parties counsel and without entering into the merits of the case, the writ petition is finally disposed of with the direction to the opposite party no. 2 to consider and decide the representation of the petitioners dated 24.05.2010, given collectively as contained in Annexure No. 3 to the writ petition, by a speaking and reasoned order, in accordance with law, within a period of ten days from the date of production of a certified copy of this order. It is further provided that if no one has joined on the place of petitioners, the said post will be kept vacant till disposal of the representation.
In view of the above, writ petition is disposed of.
