Mr.L.B.Dabhi, learned APP waives service of rule on behalf of respondent - State.
[2] The applicants are charge sheeted for the offence punishable under sections 143, 147, 148, 149, 323, 324, 326, 325, 504, 506(2), 403 of IPC as well as under section 135 of the Bombay Police Act. While releasing the applicants on bail, this Court (Coram : H.B.Antani, J.) vide order dated 13.04.2010 in Criminal Misc. Application No.3016 of 2010, imposed certain conditions. As per condition no.5(f), the applicants are required to mark their presence before the concerned Police Station twice in a month i.e. on every 1st and 15th day of every English calender month between 9.00 a.m. and 2.00 p.m. till the trial is over. To delete the said condition, present applicants have preferred this application.
[3] The order passed by this Court is in the year 2010. Till today, there is no untoward incident reported against the present applicants. The applicants have not breached any conditions imposed by this Court and has complied all the conditions. Charge sheet is also filed since long.
[4] Having heard learned advocates for the respective parties and considering above, condition no.5(f) in the order dated 13.04.2010 passed by this Court in Criminal Misc. Application No.3016 of 2010 is deleted. Rule is made absolute to the aforesaid extent. Present application is disposed of accordingly. Direct service is permitted.
