Heard learned counsel for revisionists, learned A.G.A. for the State and perused the record.
Submission is that neither allegations made in the complaint nor in statement of the complainant as witnesses recorded under Sections 200 and 202 Cr.P.C. disclose ingredients of any offence against revisionists and the dispute if any between the parties is one of the civil nature.
Considering the nature of submissions made on behalf of opposite parties and the facts stated, this Court is of the view that the matter requires consideration after receiving response from opposite parties.
Notice on behalf of opposite party no.1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable within six weeks.
List in the week commencing 5.4.2010.
Till the next date of listing, effect and operation of the order dated 12.10.2009 passed by Chief Judicial Magistrate, J.P. Nagar in case no. 3574 of 2008 Bal Kishan Vs Bulla and others under Sections 323, 504, 506, 420 I.P.C. and 3 (X) SC/ST Act, Police Station Amroha, District J.P. Nagar, shall remain stayed.
