HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23376 of 2014 ORDER:
Land to an extent of Ac. 96.30 guntas was acquired for the purpose of construction of additional Ash Pond of K.T.P.S. in Suraram Village of Paloncha Mandal, Khammam District. The claim of the petitioner is that he was landless poor and he was assigned land. The assignee was in enjoyment and cultivation of the land. Award was passed on 24.08.1984 acquiring the land, but no compensation/ex gratia is paid. Ever since the petitioner has been representing the redressal of his grievance. The proceedings of the Sub- Collector, Paloncha, dated 23.06.2009, support the stand of the petitioner that no compensation/ex gratia was paid to him. Having waited for considerable time, Appeal Case No.11 of 2010 is filed before the District Collector, Khammam, Khammam District (2nd respondent) as advised by the Sub-Collector, Paloncha, in his Memo, dated 23.06.2009, which was subsequently made over to the Joint Collector, Khammam, Khammam District (3rd respondent), to pay the compensation/ex gratia, but so far, no orders are passed. Hence, this writ petition.
2. When the matter is taken up for consideration, both the learned counsel for the petitioner as well as the learned Government Pleader submits that direction be issued to the Joint Collector, Khammam, Khammam District (3rd respondent) to pass orders on the appeal filed by the petitioner.
3. Accordingly, the Writ Petition is disposed of directing the Joint Collector, Khammam, Khammam District (3rd respondent) to pass orders on the appeal filed by the petitioner in Appeal Case No.11 of 2010, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
