Heard learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
This petition impugns the orders passed by the licensing authority under the Arms Act, 1959 as affirmed in the revision by the Commissioner. From a reading of the order made by the Commissioner, the Court notes that it has been found that the 2016 Rules have come to be promulgated and that consequently the application stated to have been made by the petitioner in 2011 cannot be proceeded with further. The Commissioner however left it open to the petitioner to apply afresh and in accordance with the 2016 Rules. In view thereof, the Court finds no ground to interfere with the order impugned.
This petition however shall stand disposed of with the following directions. It shall be open for the petitioner to apply for the grant of an arms licence afresh in accordance with the 2016 Rules. In case such an application is made within a period of two weeks from today and all statutory formalities complied with, the District Magistrate shall endeavour to dispose of that application with expedition and preferably within a period of four months from the date of presentation of a certified copy of this order.
