(Per : HONOURABLE MR.JUSTICE A.L.DAVE) By this Special Criminal Application, the petitioner seeks following reliefs:
"6.A) Your Lordships may be pleased to admit and allow this petition.
6.B) Your Lordships may be pleased to issue a writ of mandamus or certiorari or a writ in nature of mandamus or certiorari or any other writ, order or direction directing the respondent no.3 and concerned authorities to not to register marriages in such casual manner without even verifying the validity of documents annexed with the application for marriage registration.
6.C) Pending hearing and final disposal of this application Your Lordships be please to direct respondent no.2 to bring minor daughter of petitioner before this Hon'ble Court till it is ascertained that respondent no.2 after proper adjudication that future of minor girl is safe in hands of respondent no.2 minor may kindly be send to Nari Niketan. 6.C) Your Lordships may be please to grant any other and further reliefs as may be deemed just and expedient in view of the facts and circumstances of the case."
2. Conspicuously, the relief is in the nature of mandamus on the Registrar of Marriages not to register the marriage in a casual manner. Equally, conspicuously there is not even a whisper for production of corpus before the Court. The contents of the petition and the averments made in the petition do not speak of confinement of the corpus.
3. In light of above fact situation, Registry is directed to place, at the earliest, the matter before the Hon'ble the Chief Justice, for appropriate direction.
