Heard Sri Ravi Jha, Advocate holding brief of Sri Anil Srivastava, learned counsel for the revisionist, Sri Sanjive Kumar Gupta, learned counsel for opposite parties no. 2 to 4, learned A.G.A. for the State of U.P. and perused the record.
Learned counsel for the revisionist has submitted that the revision has become infructuous as per his instructions received from the revisionist.
It is pertinent to mention her that this revision has been filed against the judgment and order of acquittal dated 31.05.2001, passed by IVth Additional Sessions Judge, Budaun, in Sessions Trial No. 1070 of 1977 (State vs. Billu and others), under Sections 347, 364, 302/34 and 201 I.P.C., Police Station Ujhani, District Budaun.
It appears that it is an old revision pertaining to the year 2001 which is still awaiting admission.
In view of the submission made by learned counsel for the revisionist, the revision is dismissed as infructuous.
Interim order, if any, stands vacated.
However, it is made clear that if any appeal against the acquittal has been filed by the State, this order will have no baring on that appeal and that shall be disposed of in accordance with law.
