Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayers:-
"(i) Issue a writ, order or direction in the nauture of Mandamus commanding the Tehsildar Chunar, District Mirzapur to decide the Case No. 411, 412 and 642 of 2001 under Section 34/ 35 of Land Revenue Act, 1901, Village Pacharav, Pargana Kiriyat, Tehsil- Chunar, District Mirzapur, (Bhudev Tripathi and other vs. Panna Devi) within stipulated period.
(ii) Issue any suitable writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case to meet the ends of justice.
(iii) To award the cost of the writ petition in favour of the petitioner."
A perusal of the order-sheet indicates that on 11.1.2021 both the counsels were present and they agreed to file written submission and matter was fixed for 16.1.2021. It is submitted that thereafter nothing has been done in the matter.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 3, Nayab Tehsildar Chunar, District Mirzapur to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of two months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court, provided the functioning of the authority concerned is not affected due to any reason related to Covid-19 Pandemic as well as the lawyers are not abstaining from the work.
It is further provided that the dates on which the lawyers are abstaining from work shall be treated to be excluded from the period within which the proceedings are directed to be completed and in case the petitioners appear in person, the authority concerned shall proceed to conclude the proceedings.
With the aforesaid observations/ directions, the present petition is finally disposed of.
