Heard learned counsel for the applicants, the learned A.G.A. and perused the record.
This is a bail application on behalf of the applicants in connection with Case Crime No.260 of 2021, under Sections 147, 148, 307, 325 abd 506 I.P.C., Police Station Mau Aima, district Prayagraj.
FIR of this incident was lodged by the complainant against the accused persons and it was alleged that when the complainant was constructing boundary-wall on his land then accused persons came and they started beating the complainant and others in which Mangalesh from complainant's side received fracture of temporal region on head and the doctor has opined that the injury was grievous.
Learned counsel for the applicants has submitted that the accused are quite innocent and they have been falsely implicated with the object of injuring or humiliating the complainant by having them so arrested.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the anticipatory bail and has submitted that the FIR has not been lodged to injure or humiliate the applicants in this matter in which five persons of the applicants' side have received injury and one person of the complainant's side namely, Mangalesh has received fracture of temporal region on head.
Without expressing any opinion on the merits of the case and considering the submission advanced by learned counsel for the applicant, considering the nature of accusations, considering the gravity of offence, this Court finds that the FIR has not been lodged with the object of injuring or humiliating the applicant by having him so arrested. No good ground for grant of anticipatory bail to the applicant has been made out.
Accordingly, the anticipatory bail application is rejected.
