Heard Sri Dhirendra Kumar Srivastava, learned counsel for the applicant and Sri Ankit Srivastava, learned brief holder for the State and perused the material on record.
The case is of assault upon the deceased Nitin Kumar by a sooja. Learned counsel for the applicant places the true copy of the postmortem report wherein the injury no.1 being the antemortem injury, which is at page 25-D of the paper-book is typed as a fire wound 0.5 x 0.5 x cavity deep and the other injury which is shown as injury no.2 starts with a '........' and then the word wound is typed. Even, the Xerox of the postmortem report is incomplete and does not show about the injuries of the deceased.
On a pointed query, the learned counsel for the applicant is also unable to assist the Court regarding the nature of injuries received by the deceased.
The bail application is thus rejected on this count only.
