Heard learned counsel for the parties.
By the instant writ petition, petitioner seeks the following relief:
"i. to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 11.10.2018 passed by Additional District Magistrate (Judicial), Meerut in Case No. 01888 of 2018 (Bhopal Singh vs. Gram Sabha Laiya) under Section 67(5) U.P. Revenue Code 2006 and 06.01.2018 passed by Tehsildar (Judicial)/Assistant Collector Ist Class, Tehsil Sardhana, Meerut in Case No. T20161152042829 (Gram Sabha vs. Bhopal) under Section 67 of U.P. Revenue Code 2006."
It is urged that petitioner belongs to backward class, therefore, is entitled to the benefit under Section 67(a) of the U.P. Revenue Code, 2006.
On specific query, learned counsel for the petitioner is unable to point out from the record that the point that is being raised before this Court was pressed before the authorities. In the memo of appeal, it is contended that the ground was taken but has not been considered.
Be that as it may, since the petitioner is raising disputed questions of fact, which cannot be gone into in writ jurisdiction.
After arguing the matter at length, learned counsel for the petitioner submits that the writ petition may be dismissed as withdrawn with liberty to the petitioner to approach the appellate authority by filing an appropriate application.
In view thereof, the writ petition is dismissed as withdrawn with the aforesaid liberty.
