Heard learned counsel for the petitioner and learned A.G.A. for the State.
This petition for writ is before us with a prayer to quash the F.I.R. dated 22.10.2017 bearing Case Crime No. 508 of 2017 pending investigation at Police Station Fatehganj West, District Bareilly pertaining to the offences under Sections 376-D, 452, 323 I.P.C. and 4 of Protection of Children from Sexual Offences Act, 2012.
Learned counsel for the petitioner has sought to place reliance upon the order dated 1.2.2018 passed in Criminal Misc. Writ Petition No. 2301 of 2018 (Gause Alam vs. State of U.P. and 2 others) filed by the co-accused. We have perused the F.I.R. and we find that the main role assigned is of the petitioner Bhoora whereas Gause Alam had only been assigned the role of catching hold the arms of the victim.
In that view of the matter we are not inclined to grant any relief to the petitioner.
The writ petition is accordingly, dismissed.
