The petitioner has preferred this writ petition for a direction upon the second respondent to consider his grievance which he has raised in his representation dated 17th September, 2018. The grievance of the petitioner is that he is owner of Plot No.
567 situated in Village Chhitoni, Police Station and Tehsil Shahbad, District Rampur, however, some of the local political leaders and their followers have illegally installed a statue over the said plot without his permission against his wishes.
On the earlier occasion we had asked the learned Standing Counsel to seek instruction in the matter. He has received the instruction. On the strength of instruction he submits that first information report No. 622 of 2018 has been lodged against the miscreants and investigation is in progress. It is mentioned in the instruction that necessary decision shall be taken in accordance with law.
We have heard learned counsel for the petitioner and learned Standing Counsel. With their consent the writ petition is taken on board for final disposal at this stage in terms of the Rules of the Court. We are not issuing notice to respondent nos. 5 to 8 as their interest is protected in this order.
Taking into consideration the facts and circumstances of the case we are of the view that in order to meet the ends of justice a direction is issued upon the second respondent to consider the cause of the petitioner and take appropriate decision on the application of the petitioner in accordance with law after furnishing opportunity to the affected persons.
We make it clear that we have not expressed any opinion on the merits of the case. The second respondent shall pass the order independently in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
