Heard learned counsel for the parties and perused the record. This writ petition has been filed for following relief:
"It is therefore, most respectfully prayed that this Hon'ble court may graciously be pleased to allow this application and issue an ad interim mandamus and direct the respondents to construct the Nali from the house of Munnu Fakir to house of Indrish Pradhan in pursuance of proposal of the Gram Sabha and sanction of the deep Nali by the Governmet, during the pendency of present writ petition before this Hon'ble court, and /or to pass such other and further order which this Hon'ble Court may deem fit and proper under the circumstances of the case in the ends of justice."
Perusal of record shows that letter dated 28.09.2018 was issued by Zila Panchayat Raj Adhikari, Meerut sanctioning Rs. 459800/- for construction of alleged drain in question. This writ petition has been filed just after 2 months of the financial sanction.
In view of above, we are of the opinion that this PIL has been filed in haste as such is liable to be dismissed as premature.
With the observation made above, the petition is dismissed as premature. However, it is expected that the concerned authority will look into the matter and do the needful.
