1. Heard Sri Adesh Kumar Dixit, learned counsel for applicant, learned AGA for State and perused the material available on record.
2. The present bail application has been moved by accused-applicant for enlarging him on bail in Case Crime No. 435 of 2014, under Section 302 I.P.C. and Sections 3(2)(5) SC/ST Act, Police Station Harduaganj, District Aligarh.
3. Applicant is named in FIR. In statement given under Section 161 Cr.P.C., Informant who is an eye-witness, has supported the FIR version. Applicant has been assigned active role in the commission of offence.
4. Looking to the facts and circumstances of the case, I do not find it a fit case where applicant should be enlarged on bail.
5. As the matter is pending since last more than four years and accused-applicant is in jail since 03.02.2015, in my view, trial Court should conclude trial expeditiously.
6. Subject to above observation, bail application of applicant is rejected.
