The present appeal is filed by the appellant being aggrieved by the decree and judgment dated 06-08-1992 in O.S.No.40 of 1985 passed by the II Additional Subordinate Judge, Warangal partly decreeing the suit with costs.
2. During the pendency of the appeal, ASMP.No.785 of 2014 was filed seeking a direction to transmit the records of this appeal to the Lok Adalat, District Legal Services Authority at Warangal to enable the said authority to record compromise among the parties and this court vide order dated 23-04-2014 allowed the said application for transmitting the record of the appeal.
3. As per the directions of this court dated 23-04-2014, the District Legal Services Authority, Warangal, through its docket proceedings dated 26-09-2014, recorded memorandum of compromise as per the terms and conditions mentioned therein and the said proceedings are placed before the court, wherein it is stated that on 26-09-2014 all the parties present and the memorandum of compromise under Order 23 Rule 3 CPC already filed were explained to the parties and they agreed and accepted the terms of compromise and reported the acceptance of the terms of compromise without any coercion and with full consent. It is stated by the learned counsel for the 2nd respondent/2nd defendant that the possession was handed over to the plaintiff in terms of clause-3 of the memorandum of compromise.
4. In view of said compromise recorded by the District Legal Services Authority, Warangal on 26-09-2014, the appeal is disposed of in terms of the said compromise recorded by the District Legal Services Authority, Warangal, which shall form part of the record. There shall be no order as to costs.
