On the matter being taken up, learned AGA for the State of U.P. submitted that by the impugned order dated 14.5.2019 application of Smt. Sunita Devi has been rejected, but the present Application under Section 482 Cr.P.C. has been preferred by Bhoop Singh, therefore, the present application at the instance of Bhoop Singh is not maintainable.
On the aforesaid objection raised on behalf of learned AGA, learned counsel for the applicant submitted that he does not want to press this application and he may be permitted to withdraw this application at this stage with liberty to file a fresh application on behalf of Smt. Sunita Devi.
The prayer so made is allowed. The present application is dismissed as withdrawn with liberty to file a fresh application by Smt. Sunita Devi.
Certified copy of order dated 14.5.2019 appended as Annexure No.4 to the application be returned to the learned counsel for the applicant after retaining the xerox copy of the same.
