Learned counsel for the petitioners states that in fact this petition was presented as a petition under Article 227 of the Constitution of India because it seeks relief against private parties who are defendants in a suit already pending in the court below, but under some wrong advice, it was converted as one under Article 226 of the Constitution of India.
He, therefore, prays to withdraw this writ petition with liberty to file a fresh petition under Article 227 of the Constitution of India seeking appropriate relief.
The writ petition is dismissed as withdrawn with the aforesaid liberty.
