HONOURABLE SRI JUSTICE P. NAVEEN RAO CIVIL REVISION PETITION No. 3900 of 2014 ORDER:
This revision is filed assailing the order dated 9.9.14 passed in I A No. 698 of 2014 in O.S. No. 66 of 2011 on the file of the Senior Civil Judge Court, Sircilla, Karimnagar.
2. Revision petitioner is defendant no.1. He filed I A No. 698 of 2014 under Order 16 Rule 2 of CPC to summon the Special Deputy Collector (Land Acquisition) to give evidence and produce the record of his office pertaining to the declaration given by plaintiff/first respondent admitting the ownership of revision petitioner over the subject land. The trial Court dismissed the said petition observing that the petition lacks material particulars such as file number, award number and date of recording of the statement of plaintiff by Deputy Tahsildar; that suit was filed in the year 2011 and no effort was made by the petitioner to obtain the certified copies of the award and statement of plaintiff alleged to have been recorded by the Land Acquisition Officer.
3. Heard the learned counsel for petitioner.
4. Having heard the learned counsel for petitioner and on perusal of the material available on record, I see no error much less a patent error warranting interference of this Court. The revision petition fails and accordingly the same is hereby dismissed. No costs. Sequel to the same, miscellaneous petitions, if any pending, stand dismissed.
