Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with a prayer to direct the learned Additional Civil Judge (Jr. Div.)/ Judicial Magistrate, Court No. III, Fatehpur to decide the Case No. 2913 of 2006 (Bholanath Uttam Vs. Rajesh Kumar Uttam), under Section 138 of Negotiable Instruments Act and Section 418 IPC, Police Station Jahanabad, District Fatehpur within stipulated period.
Learned counsel for the applicant has submitted that the complaint has been filed by the applicant on 04.07.2006 and since then, proceeding has been lingering-on, on one pretext or the other.
In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned court below is directed to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of six months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
