Heard learned counsel for the parties.
The applicant is before this Court against the opposite party for wilful defiance of the order dated 12.09.2014 passed in Writ-A No.49143 of 2014 (Bhola v. UPSRTC & Ors.). The order dated 12.9.2014 is quoted as under:-
"It transpires from the record that the petitioner was working with respondent no.2 Regional Manager, U.P State Road Transport Corporation, Gorakhpur since 1.6.1972. The petitioner retired on 31.8.2011 on attaining the age of superannuation.
The petitioner has approached this Court seeking a direction to the respondents to pay all retiral dues and terminal benefits including Assured Carrier Progression (ACP) and regular pension along with interest.
Shri Sunil Kumar Mishra learned counsel appearing for the respondents submits that some of the retiral benefits has already been paid, however, the grievance of the petitioner shall be considered by respondent no. 2, Regional Manager, U.P State Road Transport Corporation, Gorakhpur.
In such view of the matter, on the consent of the parties, the writ petition is disposed of with a direction to respondent no. 2 Regional Manager, U.P State Road Transport Corporation, Gorakhpur to consider and decide the representation of the petitioner by a reasoned and speaking order within a period of three months from the date of production of certified copy of this order along with a fresh representation.
The writ petition is accordingly, disposed of."
It is admitted situation that the aforesaid order has not been complied with by the opposite parties.
Considering the facts and circumstances of the case, the opposite parties are directed to finalise the claim of the applicant as has been observed by the writ Court in question expeditiously and preferably within two months from the date of production of certified copy of this order.
The contempt application stands disposed of accordingly. Notices, if any, stand discharged.
