Sri R.K.Yadav appears for the opposite party and apprised to the Court that the gratuity amount could not be released in favour of the applicant as the matter was taken on 24.09.2019 and the same shall be ensured to the applicant at the earliest.
Learned counsel for the applicant submits that till date no payment qua to the retiral benefits has not been extended to the applicant in compliance of the Writ Court's order and, thus, the opposite party has committed civil contempt liable for punishment under Section 12 of the Contempt of Courts Act, 1971.
Prima facie a case of contempt has been made out. However, considering the facts and circumstances of the case, one more opportunity is afforded to the opposite party to comply with the order of Writ Court and to ensure the entire payment towards retiral benefits to the applicant within two months from the date of production of a certified copy of this order, failing which, the applicant would be at liberty to move a fresh application, if the order is not complied with by the opposite party within the stipulated time as aforementioned.
With the aforesaid observations, this application is disposed of at this stage.
