None appears to press the revision despite repeated calls.
By the order dated 09.01.1992, the Chief Judicial Magistrate, Mirzapur had directed the revisionist to pay an amount of Rs.11,900/- to the applicant-opposite party No.2 herein for the loss of confiscated rice and pulse. The appellate court had confirmed the aforesaid order passed by the trial court.
A categorical finding has been recorded by the trial court that the foodgrains were given in the custody of the revisionist who illegally sold it during the confiscation. The order of confiscation of the foodgrains had been set aside and the applicant/opposite party No.2 was entitled for the release of the said confiscated goods/food-grains.
After getting the valuation of the confiscated foodgrains, an amount of Rs.11,900/- has been computed towards total evaluation which was to be paid to the applicant/opposite party No.2.
As there is no dispute about the fact that the foodgrains were given in the custody of the revisionist, no infirmity is found in the orders impugned.
The revision is found devoid of merits and hence dismissed. Certify the judgment to the court below immediately.
