JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 27221 of 2002 Petitioner :- Bhoj Raj Singh Respondent :- State Of U.P. Thru Secy. Secondary Education And Ors.
Counsel for Petitioner :- V.K. Shukla,Dheeraj Singh Counsel for Respondent :- C.S.C.,R.K. Upadhyay
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"a. issue a writ, order or direction in the nature of Certiorari, calling for the records of this case, and to quash the Orders dated 26.2.2001,, passed by the Jt. Director of Education, Ist Region, Meerut (Annexure'13' to this writ petition) and the Orders dated 23.10.2001 and 18.5.2002, passed by the District Inspector of Schools, Bulandshahr (Annexures '15' and '16' respectively to this writ petition);
b. issue a writ, order or direction in the nature of mandamus commanding and restraining the respondents not to interfere in the peaceful functioning of the petitioner, as officiating Principal of Janta Inter College, Khandoi, District Bulandshahr.
c. issue a writ, order or direction in the nature of mandamus , declaring the Provisions as contained under Chapter II Regulation 3(b), which provides that seniority of teacher of any grade shall be determined on the basis of their substantive appointment and on this view of the fact and background, the orders passed are ultra vires, being violative of Articles 14 and 21 of the Constitution of India."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
