By way of this application, the applicant-original accused has prayed for deletion/ modification of condition imposed by this Court vide order dated March 16, 2011 passed in Criminal Miscellaneous Application No.3302 of 2011, whereby the applicant was ordered to be released on bail in connection with the offence registered with Kutiyana Police Station punishable under Sections 406, 409, 420, 465, 467, 471 and 120(B) of the Indian Penal Code.
Having heard the learned advocate Mr.Yash Joshi appearing on behalf of Mr.Nirav C. Thakkar for the applicant and Mr.J.K. Shah, learned Additional Public Prosecutor appearing on behalf of the respondent-State, I am of the view that the condition imposed by this Court being Condition No.7 Clause (f) deserves to be deleted as the applicant-accused has been appearing regularly before the concerned trial Court. Under the circumstances, the condition of marking presence before the concerned Police Station on every fourth Sunday between 09-00 a.m. and 05-00 p.m. stands deleted. The rest of the conditions of the order dated March 16, 2011 remains unaltered and the same shall be abided by the applicant accordingly.
Rule is made absolute to the aforesaid extent.
