Heard Sri Sharique Ahmed, learned counsel for the applicant, Sri Ashish Pandey, learned A.G.A. for the State and perused the record.
It has been argued by learned counsel for the applicant that the applicant along with five accused persons are said to have given indiscriminate firing upon the deceased. Learned counsel for the applicant states that till date the statement of only one witness of fact has been recorded by the trial court. The applicant is in jail since 10.1.2014.
Learned AGA opposed the prayer for bail and submitted that the applicant and other accused persons have the role of firing upon the deceased who received six entry wound on his person. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Bhim Sonkar, involved in case crime no. 05/2014, under Sections 147, 148, 149, 302 IPC, P.S. Juhi, District Kanpur Nagar is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a period of six months from the date of production of certified copy of this order before the trial court.
The applicant is directed to produce the certified copy of this order before the trial court for it's compliance.
