Heard Mr.Pravin Gondaliya, learned advocate for the petitioner. It is submitted by him that the petitioner is cultivating the land since the year 1973 and by the impugned order of the Collector dated 29.03.2008, not only has the application of the petitioner for grant of land on permanent basis been rejected, but the allotment of the land in favour of the petitioner has been rejected and the land has been directed to be forfeited to to the State Government. It is further submitted that while upholding the order of the Collector, the Secretary, in the impugned order dated 21.10.2011, has stated that there is no provision for grant of land on a permanent basis. However, the similarly situated person has been granted land on a permanent basis, which is evident from the order passed in the month of April, 1981, annexed as Annexure-H (Colly.), on running page No.38 of the paper-book.
Issue Notice returnable on 01.03.2012.
Status-quo, as it exists today, qua the land in question, shall be maintained till then.
In addition to the normal mode of service, Direct Service is also permitted.
