(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) 1.0 Present application is filed by Smt. Bhikhiben, wife of Somjibhai Bhimbhai Chudasama seeking Temporary Bail for a period of one month on the ground of marriage of her younger son, which is scheduled on 12th February 2012.
2.0 Rule.
Learned Additional Public Prosecutor Mr. Kodekar waives service of Rule.
3.0 The applicant - convict is undergoing life imprisonment in connection with the Sessions Case No. 10 of 2006 for the offence punishable under Section 302 of the IPC.
3.1 The applicant - convict has enjoyed two Temporary Bail, one in the year 2008 and another in the year 2010. She has also enjoyed two furloughs, one in the year 2009 and another in the year 2011. Every time, she has reported in jail in time. Except one warning, her conduct in jail is found to be satisfactory.
4.0 For the contents of the application, the same is allowed. The applicant
- convict is ordered to be released on Temporary Bail up to 17th February 2012 from the date of his release, on her executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities. She shall report back in jail on 18th February 2012.
4.1 Rule is made absolute to the aforesaid extent.
4.2 The Registry is directed to communicate this order to the Jail Authorities by fax.
