ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 23.07.2013, in Writ Petition No.21591 of 2013.
Respondent No.1 filed a counter-affidavit, wherein he has, inter alia, stated that in obedience to the order of this Court, survey of the lands was held on 19.06.2014.
Learned counsel for the petitioner stated that though survey is stated to have been held, the survey report has not been furnished to the petitioner.
A perusal of the above-mentioned order of this Court would show that no direction was given to the respondents to furnish a copy of the survey report to the petitioner. Therefore, non-furnishing of a copy of the survey report to the petitioner does not constitute violation of order of this Court. However, the petitioner is permitted to approach respondent No.1 with a request to furnish a copy of the survey report and on such approach, respondent No.1 shall furnish a copy of the same to the petitioner, subject to payment of cost of the survey report if any required.
Subject to the above direction, the Contempt Case is closed.
