… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.16796 OF 2004 O R D E R The grievance of the petitioner in this case was that his lands in Sy.Nos.276, 282 and 283 of Shamshabad Village and Mandal were sought to be utilized for the purpose of road widening without due acquisition in accordance with law.
By interim order dated 20.09.2004 passed in WPMP No.21974 of 2004 filed in this writ petition, this Court directed that without a notification being issued under the National Highways Act, the petitioner should not be deprived of his property for widening of the highway.
Despite the matter being pending on the file of this Court for the past decade, no counter-affidavit has been filed by the respondents.
The writ petition is accordingly disposed of in terms of the interim order directing the respondents not to proceed against the petitioner’s lands or deprive him of the same without following the due procedure laid down by law. No order as to costs.
