Heard learned counsel for the petitioner and Sri Dilip Kumar Yadav, learned counsel for the opposite party no. 2.
This petition under Article 227 of the Constitution of India is directed against the order dated 4th January, 2019 whereby while entertaining the revision application in proceeding under Section 145 Cr.P.C. , the Court has admitted the revision and issued notice and stayed the order dated 30th November, 2018.
In the opinion of the Court, opportunity is still with the petitioner to contest the revision on merits at this stage.
Both the counsel for the parties agreed that direction may be issued for disposal of the pending revision petition by the court below in a time bound period.
Learned Additional Government Advocate has no objection in case if direction is issued for disposal of the pending revision in stipulated period of time.
In view of above, let revision petition of the opposite party no. 2 be decided on merits after giving full opportunity of hearing to the parties within period of three months from the date of production of certified copy of the order .
In view of aforesaid observations and directions, the petition is disposed of.
