Heard Sri Shivendra Kumar Gupta, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to direct the learned Additional Session Judge/Special Judge SC/ST (P.A.) Act, Badaun to expedite the trial of Complaint Case No. 696 of 2018 (Bheem Sen vs. Devpal), Police Station- Ugaiti, District- Badaun, within a stipulated period.
Learned counsel for the applicant submits that the applicant is the first informant in the aforesaid case. It is submitted that the accused persons are misusing the liberty of bail and are not turning up for trial.
Without expressing any opinion on the merits of the case, as this Court is not aware of the schedule/docket of the trial court concerned, it is expected that the trial court will make all endeavor to decide the each case early.
In view of above, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the Additional Session Judge/Special Judge SC/ST (P.A.) Act, Badaun to decide the aforesaid case as expeditiously as possible, as per provisions of the law itself. The trial court is further directed to take stern, strict and coercive measures to secure and procure their presence before it, if the accused are adopting dilatory tactics to delay the trial.
