Criminal Misc. Bail Application No.8 of 2019:-
Heard learned counsel for the appellant as well as learned A.G.A. for the State and perused the record.
The present application has been filed by the appellant in Sessions Trial No.549 of 2004, under Sections - 304(II)/34, 323/34 I.P.C., Police Station - Govardhan, District-Mathura with the prayer to enlarge him on bail.
The urge is that non bailable warrant has been executed and pursuant thereto the applicant is in jail. Now, straightway promise has been made that learned counsel for the appellant is ready to extend final argument as and when the Court directs and appellant will not occasion any delay and will not repeat his earlier mistake. Previously, the appellant was on bail vide previous order of this Court dated 2.9.2008.
Also heard the learned A.G.A.
After considering the entirety of the case and the promise extended that argument on final hearing of the appeal will be extended very shortly on any date fixed, the applicant is entitled to be released on bail.
Let the appellant - Bhawar Singh be released on bail in the aforesaid case on his furnishing a personal bond of the previous amount and two reliable sureties each in the like amount to the satisfaction of the court concerned.
As soon as personal and surety bonds are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by C.J.M. Mathura to be kept on the record of this appeal.
List this case after one month.
In the meanwhile, office is directed to prepare the paper book.
