Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
Learned counsel for the applicants submitted that recovery of 275 gm opium was shown from joint possession of the applicants and one other co-accused Lakhdeep Singh. Co-accused Lakhdeep Singh has already been released on bail. There is no criminal history of the applicants and they are in jail in the present case since 07.5.2010.The applicants will not misuse liberty of bail and will not repeat such activities and will cooperate with trial, if they are released on bail.
Considering the facts, without expressing any opinion on merits of the case, let the applicants namely, Bhawani Nath and Ranjodh Singh be released on bail in Case Crime No. 199 of 2010, under section 18/20 N.D.P.S. Act, P.S. Nakud, District Saharanpur on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
