This Court on 11.10.2012 passed the following order:
"This Court on 17th September, 2012, in S.C.A. No.8576 of 2008 has passed following order:-
"RULE.
The learned counsel for the respondents will file reply within six months. If the reply is filed, the learned counsel for the petitioner will file an application for early hearing."
2. Thereafter, this Court again on 4th May, 2010, in Civil Application No.4854 of 2010 filed in S.C.A. No. 8576 has passed following order:-
Heard.
In view of the averments made in the application, the same is allowed in terms of paragraph Nos. 5(A) and 5(B). Main matter is peremptorily fixed on 29.07.2010. In the meantime, the respondent shall file their reply and take decision as requested by the applicants.
With the above observation, petition stands disposed of.
3. In spite of earlier orders, no reply has been filed by the respondents as yet. Therefore, the respondent No.3 and 6 are directed to file their Reply on or before 7th November, 2012, failing which they will remain present in person before this Court on 8th November, 2012. S.O. to 8th November, 2012."
In spite of the aforesaid order, respondent Nos. 3 and 6 have not filed their reply nor have they remained present before this Court. Therefore, it is defiance of the Court's order.
Therefore, the Director of Primary Education is directed to take immediate action against respondent Nos. 3 and 6 for defying the order of the Court.
Notice is also issued against respondent Nos. 3 and 6 why contempt proceedings should not be initiated against them for defying the order of the Court. Office is directed to issue writ to respondent No. 2 as well as notice to respondent Nos. 3 and 6 for the contempt proceedings.
Notice returnable on 13.12.2012. Learned advocate Mr. Vaishnav for the petitioners will take direct service to serve the concerned respondents.
