1.0 This petition is directed against the judgement and award dated 09.08.2004 passed by the learned Presiding Officer, Labour Court, Bhavnagar in Reference ( LCB) No. 326 of 1992 directing the petitioners to reinstate the respondent in service with 25% backwages.
2.0 It is stated by learned advocate for the respondent that the respondent had expired and his mother is the only legal heir. In that view of the matter and in view of decision of Hon’ble Supreme Court in case of Senior Superintendent Telegraph (Traffic), Bhopal, Vs. Santosh Kumar Seal and others, reported in 2010(6) SCC 773, grant of monetary compensation would meet the ends of justice. In my considered view the mother of the respondent shall be paid lumpsum compensation, which is quantified at Rs.4 0,000/, by the petitioners till 31.01.2013.
3.0 The petition stands disposed of. Rule is made absolute to the aforesaid extent with no order as to costs. Direct service to the respondent is permitted.
