Office report dated 8.4.2019 reflects that amount of Rs.50,000/- has not been deposited by the petitioner no.2 in compliance of the order dated 3.12.2018. The petitioner no.2 was again afforded opportunity by the Court vide an order dated 9.4.2019, yet the orders have not been complied with. Perusal of the record indicates that the statement of the corpus was recorded under Section 164 Cr.P.C. in which she has stated that the petitioner no.2, Ranu Parihar @ Ramakant had forcibly committed rape upon her and he is also her distant relative.
Keeping in view the statement of the corpus recorded under Section 164 Cr.P.C., the instant habeas corpus writ petition has no force as the petitioner no.2 is an accused in Case Crime No.494 of 2017, under Sections 363, 365, 366, 368 I.P.C., P.S. Sipari Bazar, District Jhansi.
The present habeas corpus writ petition is bereft of merits and the same is, accordingly, dismissed.
