Heard Ms. Mamta Vyas, learned Advocate for the petitioner. Ms. Vyas has relied upon Government Circular dated 18.06.1999 which was applicable then, wherein, in condition no.2 it is specifically provided that same should apply in three contingencies viz. due to retirement or on any vacant post and on a post which is already vacant. However, considering the order dated 9.5.2011 (Annexure 'A' to the petitions) the authority has considered it in a different manner. The respondent is therefore directed to file Affidavit explaining the contents of resolution dated 18.06.1999 latest by returnable date. Hence, notice returnable on 21.02.2012.
