Heard learned counsel for the applicant and learned A.G.A. for State.
The present anticipatory bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No.0210 of 2017, under Sections 406, 408, 427, 504, 506 I.P.C., Police Station NOIDA Sector-58, District Gautam Budh Nagar.
Learned counsel for the applicant submits that the applicant is innocent and have been falsely implicated in the present case. The prosecution story is false and fake. It is further submitted that the present F.I.R. has been lodged on the basis of an application under Section 156(3) Cr.P.C. Although, the applicant is named in F.I.R. but he has no concerned with the present case. Nothing has been recovered from the possession of applicant. He further argued that if the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned AGA vehemently opposed the application and submitted that the charge sheet, after investigating has been submitted to the Court and trial is going on.
After hearing the learned counsel for the applicant and learned A.G.A., and after perusing the averments made in the present anticipatory bail application as well as rejection order, this Court is of the opinion, no case for anticipatory bail is made out.
Accordingly, the anticipatory bail application filed on behalf of the applicant is hereby rejected.
