JUDGMENT / ORDER

Learned advocate has submitted that unfortunately the petitioner could not produce all the relevant documents before the concerned authority which would justify demand for license for keeping arm. The prayer is made to permit the petitioner to file fresh application and the same, if filed, be ordered to be considered in its own merits.
Learned AGP submits that there cannot be any objection for such a request, otherwise the order as on date is absolutely just and proper.
This Court is of the view that merely remanding the matter, and enabling the petitioner to place on record relevant material would be of no avail. Therefore, without disturbing present order, liberty is given to the petitioner to file fresh application for seeking license, and the same shall be decided on merits by the concerned authority, without being influenced by the fact that earlier the application for grant of incense was rejected. With this observation the petition is disposed of. Notice discharged. No costs.
