(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present case is for confirmation of death sentence imposed upon original accused No.1 by the learned 3rd Additional Sessions Judge, Jamnagar in Sessions Case No.164 of 2000. When we further considered the record it appears that this Court vide order dated 5th September 2011 had directed the office to undertake the procedure as required under Rule 344 of the Gujarat High Court Rules, 1993. Rule 344 of the said Rules provides for preparation of 35 copies of the paper-book. We are unable to get the rationale for preparation of 35 copies of the paper-book in a confirmation case. It, prima-facie, appears that in reality, the preparation of 35 copies of the paper-book may not be required. However, before we make appropriate observation in this regard, it would be just and proper to call for the report of the Registry of this Court about the justification of preparation of 35 copies of the paper-book in a confirmation case. The Registry shall also further state as to whether 35 copies are actually required or not and if yes, for what purpose. The Registry shall also give details about CC/11/2011 2/2 ORDER the actual number of copies as may be required for conclusion of the confirmation case either before this Court or may be before the Apex Court. Such report shall be submitted on or before 2 nd November 2012.
