This writ petition has been filed, inter alia, for the following reliefs:-
"i) issue a writ, order or direction in the nature of certiorari quashing the auction notice dated 5.12.2019 issued by the respondent no. 2 (Annexure no. 1 to the writ petition)."
Heard learned counsel for the petitioner, Sri Sandeep Kumar Singh, learned counsel for the Bank and perused the record.
At the very outset, learned counsel for the Bank stated that the present writ petition is not maintainable on the ground of alternative remedy. He further submitted that the petitioner has got an alternative remedy to file an appeal before the concerned appellate authority.
In view of the above, we are not inclined to entertain this writ petition for reasons that there is availability of alternative remedy. The writ petition is, accordingly, dismissed. However, it is open for the petitioner to seek appropriate remedy before the appropriate forum in accordance with law.
