(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant convict for temporary bail on the ground that he wants to take care of the treatment of his wife.
Pursuant to the earlier order passed by this Court, the learned APP based on the instructions received by him from the Police Sub Inspector, Pandesara Police Station states that the pain in the stomach and chest is there. Certificate also does not show any major sickness for which major surgery may be required or otherwise.
Further, the applicant is desirous to go to UP outside the Gujarat territory. Under the circumstances, the discretion does not deserve to be exercised at this stage.
Hence, the application is not granted. Rule discharged.
