----------------------- The petitioner is the owner of quarrying permit for ordinary sand. Ext.P2 is the quarrying permit issued by the 1st respondent, Geologist. The petitioner has submitted an application for renewing Ext.P2 on expiry. The petitioner has approached the District Collector for NOC. The District Collector granted NOC on condition that the petitioner shall produce environmental clearance from the State Environmental Impact Assessment Authority.
2. The petitioner submits that in view of the judgment of this Court as per Ext.P6, he is entitiled for renewal of Ext.P2 without insisting for environmental clearance. If the petitioner could not remove the entire quantity of ordinary sand in respect of the area mentioned in Exts.P1 and P2, after ascertaining the above facts the Geologist shall renew the permit.
3. In view of the above, Ext.P5 order is set aside. Needful W.P.(C).No.31196 of 2014 2 shall be done within a period of two weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
